Contact - Jaycapturedit Photography

This contract is entered into by and between [Jaycapturedit] the Photographer and the client [Client filling out form below] collectively.

1. Services

Photographer agrees to provide photography services as outlined in the agreed-upon package or as discussed and documented in writing. All props (balloons, confetti, cake, flowers, etc.) must be provided by the client, unless already acquired by photographer. Have ideas/inspiration for photo session ready before you booking.

2. Date, Time, and Location

The specific date, time, and location of the photography session or event will be mutually agreed upon by both Parties.

3. Payment

Client agrees to pay the total fee as specified & provided by Photographer. A 50% non-refundable deposit is required upon booking, with the remaining balance due on day of photo session. NO DEPOSIT = NO APPOINTMENT.

4. Cancellation and Rescheduling

In the event of cancellation by either party, the non-refundable deposit shall be retained by the Photographer. (In the event of cancellation, for all studio sessions, an additional deposit is required due to studio availability.) Rescheduling is subject to availability and should be communicated in advance.

5. Image Delivery

Photographer will deliver edited high-resolution images to the Client within 1-2 weeks after the session via digital mail. Raw files (unedited photos) will not be included in the delivery.

6. Copyright and Usage

The Photographer retains the copyright to all images. Client is granted personal use rights only. Any commercial use requires written consent from the Photographer.

7. Model Release

Client grants Photographer permission to use images for promotional purposes, including but not limited to website, portfolio, and social media, unless otherwise specified in writing.

8. Liability

Photographer is not responsible for injuries or damages during the photography session. Client is responsible for the behavior of all parties involved.

9. Unforeseeable Circumstances

In the event of unforeseen circumstances such as illness, accident, or other emergencies, Photographer reserves the right to reschedule the session.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state in which photography session is being held.
